Government Announces Relaxation Of Rules Around Annual Leave

Up until the COVID-19 outbreak, employees could not carry 4 weeks’ annual leave beyond the end of the year. The Government has decided to amend the Working Time Regulations so that where it is not reasonably practicable for employees to take some, or all, of the holiday to which they are entitled due to the coronavirus, they have a right to carry the 4 weeks leave into the next 2 leave years if needed.

Workers in the UK also have an additional 1.6 weeks’ leave (including Bank Holidays) to which they are entitled. The new regulations will not apply to these remaining 1.6 weeks’ leave, but this can be carried forward one year by agreement between workers and employers under current law anyway.

The Government’s objective is to protect employees’ annual leave entitlement so that it’s not lost, whilst ensuring that businesses have some flexibility during the current uncertainty.
